Dave Mirra, the professional BMX rider whose name and endorsement has helped Acclaim to sell over three million copies of its BMX titles in the past two years, has filed a lawsuit against the publisher over its controversial "racy" game, BMX XXX.

Mirra claims that Acclaim has besmirched his good name by associating it with the game despite an earlier agreement between himself and the company to remove all references to him from the title.

The Dave Mirra brand was attached to BMX XXX at early stages in the development, and Mirra claims that he believed that its content would contain non-offensive slapstick or satirical humour at this time. Once he became aware that the content of the game was more sexually explicit and pornographic, he "expressed grave concern over his association" and demanded that he be disassociated from it.
