CDV's position gets complicated

Posted on Saturday, 17 April 2010 by Speed, source: Gamasutra
Some more information has surfaced with regards to CDV's financial issues and things are more complicated than you might think of at first.

Some time ago, Southpeak Interactive and CDV went to court in the UK and the first was ordered to pay a settlement to the latter due to copyright infringement following a distribution deal surrounding Gamecock (Velvet Assassin) that went sour.

Instead of just paying the fine, Southpeak then bought dev studio IRP, a studio that was owed still €4,4 million by CDV, and filed a countersuit to the German publisher for that money.

As a result, CDV has filed for insolvency earlier this week, but did state that they will remain operational while a court administrator helps them get things sorted out:
"The Administrator together with the management team is now proactively working on solutions to restructure the company and discussions with investors and potential purchasers are on-going."
This isn't the first time Southpeak uses some shady tactics to get out of payments they're due. Former Gamecock CEO Mike Wilson earlier already defended CDV in their lawsuit against Southpeak, calling the latter "crooks":
"I've dealt with some shady folks in this business, but never have I seen the likes of the tactics SouthPeak has stooped to continually in an effort to not pay anyone they owed through the acquisition."

"The good news is that, like CDV, anyone with the wherewithal to fight these crooks in court wins. It's just a shame that so many of the companies they shoved around were too small to fight back."
Well, seems CDV isn't winning at all and we're sure this won't be the last we've heard about this.
