Duke Forever still being developed?

Duke not dead yet?

In a filing for the lawsuit of Take2 against Apogee/3D Realms, the latter stated development for Duke Nukem Forever is still ongoing.

3D Realms' specifically notes that it continues to work on "the development of" Duke Nukem Forever, though "it released the majority of its employees working on the development" because of a "lack of funding to sustain the high level of development."

Strange to hear that 3D Realms is still working on the game seeing that the studio not only has laid off its employees but also shut down. Or are George Broussard and Scott Miller doing everything themselves now?
