ESRB goes out of line?

Apache from VE3D recently received an e-mail which looked very much like those 419's. You know, those 'I've got a crapload of money, but i need a European bank account to get it and I will give you a huge share of the money if you help me'-mails.

However, it seems we're talking about a mail sent by ESRB (the company which rates video games and appoints them with an age rating in the US of A) in which they're announcing a $10.000 fine if Apache doesn't adjust his gaming website to the demands of the ESRB.
The ESRB requires that upon receipt of this notice, XXXXXXX immediately take the following corrective actions:

As applicable, immediately refrain from any further use of the noncompliant rating information and display the appropriate rating and/or content descriptor(s)

Immediately refrain from any further use of the Rating Pending icon and replace with the appropriate rating and, if applicable, content descriptor(s).

As applicable, immediately refrain from any further use of the noncompliant rating information and replace all incorrect rating(s) and/or content descriptor(s) with the appropriate rating(s) and/or content descriptors.

Isn't $10.000 a bit over exaggerated for some out of date information (and after all no-one pays attention to it anyways)?
