Nintendo blocks Mii use 3rd party devs?

According to a developer at Electronic Arts, Nintendo doesn't offer any tools to use the Mii characters in the games they develop.

If the company wants Miis to become a lasting sticky application, it'd be wise to acclimatize third-party developers sooner rather than later. Regardless, Miis have the potential to usher in true user-generated game characters on consoles.

It would be better if more games use the Miis, because if they are limited to some party games of Nintendo, the little guys could die very quickly.
