Take-Two files complaint against Thompson

Posted on Friday, 16 March 2007 by Anneleen, source: Gamespot
Take-Two is more than tired of Jack Thompson's continuing law suits. Consequently they have filed a complaint against him.

Take-Two asks that Florida's public nuisance law doesn't apply to any game and is also seeking an injunction to prevent Thompson from filing suit to prevent the distribution of those games or even to review their content before release.

Their arguments:
-prohibiting games is against freedom of speech
-the public nuisance law isn't clear enough

An extract out of the complaint:

"These terms have no clear meaning in the context of videogames, and persons of ordinary intelligence are forced to guess at the meaning and scope of statutes as applied to videogames. ... Because of the lack of clear, defined terms, application of the statutes will restrict a far broader range of videogames than GTA IV and Manhunt 2 because Plaintiff's distributors likely will respond to the uncertainty and fear of penalties by withholding Plaintiff's videogame from the public. As a result, Plaintiff's protected expression will not reach willing recipients."

Isn't Mr. Thompson a public nuisance himself?

This pre-emptive strike by 2K is a great idea. More publishers should do this.

Someone should start a class action suit against him. Or several.

He means that they are turning the tables on him and putting him on the defensive. Whather it will work is another matter.

Attack him in the court before he attacks them.

It makes sense to me. Does that mean I'm an idiot too?
